The Bail Bond Process

The bail agent guarantees to the court the appearance of the Defendant for every court date. If a defendant fails to appear for their scheduled court appearance, the bond is forfeited and a warrant issued by the court. At this point the indemnitors will be liable to pay the amount of the bond. For this service, the defendant is charged a premium. The amount charged to the indemnitor is 10% on state charges, and 15% of federal charges in Florida. The rates are regulated by the Department of Financial Services.

    A. Many people accused of a crime need to post bail in order to obtain their freedom. This can be done by the detainee’s family or friends paying the full bail amount directly to the jail. If the money is unavailable a bail bond company can post the bail amount for the detainee. This is known as a surety bail bond and it will guarantee the defendants freedom while attending their court proceedings. When a bail bond company agrees to post bail, they are assuming responsibility for the defendant and are insuring the courts that he/she will appear at each and every court date that the courts direct.

    Because of this responsibility and the cost involved the bail bond company receives ten percent of the total bail amount as payment. This is a standardized fee and is a State regulated amount.
